Workplace Accidents

Spalding and South Holland are home to one of the largest concentrations of agricultural and food processing businesses in the country. Over half of all jobs in the district are linked to the agri-food sector, and workplace injuries in these industries are unfortunately common.

We handle claims for injuries sustained in:

  • Food processing and packing facilities – including machinery accidents, repetitive strain injuries, slips on wet factory floors, cuts from equipment, and injuries in cold storage environments
  • Agricultural and horticultural work – including farm machinery accidents, falls from height, manual handling injuries, injuries from livestock, and exposure to chemicals or pesticides
  • Warehouses and logistics operations – including loading and unloading injuries, forklift accidents, falling objects, and injuries caused by inadequate safety equipment

Your employer has a legal duty to provide a safe working environment, proper training, and appropriate safety equipment. If they have failed in this duty and you have been injured as a result, you are entitled to claim compensation.

Road Traffic Accidents

The A16 and A17 are the main routes through Spalding and South Holland, and both have a well-documented history of serious collisions. The rural roads connecting villages such as Pinchbeck, Gosberton, and Surfleet present additional hazards, including narrow lanes, limited lighting, poor road surfaces, and slow-moving agricultural vehicles.

We represent clients injured as:

  • Drivers and passengers in car accidents
  • Motorcyclists
  • Cyclists
  • Pedestrians
  • Passengers in buses or taxis

Whether your accident happened on the A16, the A17, or a rural lane near Holbeach, we can assess your claim.

Slips, Trips, and Falls

If you have been injured due to a hazard on someone else’s property or in a public space, you may have a claim. Common examples include:

  • Wet or uneven flooring in shops or supermarkets
  • Poorly maintained pavements or paths
  • Inadequate lighting in car parks or communal areas
  • Defective stairs or flooring in rented properties

Other Claims We Handle

  • Catastrophic injuries – including brain injuries, spinal cord injuries, amputations, and severe burns
  • Fatal accident claims – supporting families who have lost a loved one due to someone else’s negligence
  • Public liability claims – injuries caused by hazards in public places or on business premises
  • Industrial disease – conditions caused by long-term workplace exposure, including respiratory conditions and hearing loss

We follow a structured process to give your claim the strongest chance of success.

Step 1: Free Initial Consultation

We discuss the circumstances of your injury, assess whether you have a viable claim, and explain what to expect. There is no obligation to proceed.

Step 2: Gathering Evidence

We collect the evidence needed to support your claim, including medical records, accident reports, witness statements, photographs, and any CCTV footage.

Step 3: Letter of Claim

We send a formal letter to the party responsible for your injury, setting out the details of your claim and the evidence supporting it.

Step 4: The Defendant Responds

The defendant has a set period to investigate your claim and either accept or deny liability. Most defendants are represented by their insurance company.

Step 5: Medical Assessment

You attend an independent medical examination to document the full extent of your injuries and their impact on your daily life.

Step 6: Valuing Your Claim

We calculate the total value of your claim based on the severity of your injuries plus any financial losses you have incurred.

Step 7: Negotiation and Settlement

We negotiate with the defendant’s representatives to secure fair compensation. The majority of personal injury claims are settled through negotiation without going to court.

Step 8: Court Proceedings (if needed)

If a fair settlement cannot be reached, we issue court proceedings on your behalf. Even at this stage, most claims settle before reaching a full trial.

How long does a claim take? Most personal injury claims are resolved within 12 to 18 months, though straightforward cases can settle sooner and complex claims (such as catastrophic injuries) may take longer. We keep you informed of progress throughout.

Personal injury compensation covers two categories of loss:

General Damages

Compensation for the injury itself, including:

  • Physical pain and suffering
  • Loss of mobility or function
  • Psychological impact, including anxiety, depression, and PTSD
  • Reduced quality of life

Special Damages

Compensation for the financial costs resulting from your injury, including:

  • Lost earnings (past and future)
  • Medical treatment and rehabilitation costs
  • Travel expenses for medical appointments
  • Care and assistance costs
  • Adaptations to your home or vehicle
  • Damaged personal property

Every claim is assessed individually. The amount of compensation depends on the severity of your injuries, their impact on your life, and the financial losses you have incurred.

All of our personal injury claims are handled on a no win no fee basis, formally known as a conditional fee arrangement (CFA). This means:

  • No upfront costs. You do not pay anything to begin your claim.
  • No fees if unsuccessful. If your claim does not succeed, you owe us nothing.
  • A success fee applies only if you win. If we secure compensation for you, our fee is taken as a percentage of your award. This percentage is agreed with you in advance and is capped by law.

This arrangement exists so that anyone who has been injured through no fault of their own can access legal representation, regardless of their financial situation.

How long do I have to make a personal injury claim?

In most cases, you have three years from the date of your injury (or the date you became aware your injury was caused by someone else’s negligence) to start legal proceedings. There are exceptions: if the injured person is under 18, the three-year period does not begin until their 18th birthday. Given these time limits, it is advisable to seek legal advice as soon as possible after your accident.

Can I claim for a workplace injury without losing my job?

Yes. It is unlawful for an employer to dismiss or disadvantage you for making a personal injury claim. In practice, workplace injury claims are handled by your employer’s liability insurer, not your employer directly. The claim is a legal matter between you and the insurer.

How much does it cost to make a personal injury claim?

Nothing upfront. We handle all personal injury claims on a no win no fee basis. If your claim is unsuccessful, you pay nothing. If we secure compensation, our success fee is taken as an agreed percentage of your award, which is capped by law and explained to you before you proceed.

Do I need to attend court?

The large majority of personal injury claims settle through negotiation without a court hearing. If your claim does proceed to court, your solicitor prepares the case and represents your interests throughout. We always aim to resolve claims as efficiently as possible.

What evidence do I need to support my claim?

Useful evidence includes photographs of the accident scene and your injuries, medical records, an accident report (particularly for workplace injuries), witness contact details, and any correspondence related to the incident. If you do not have all of this, do not worry – we can help gather the evidence needed once your claim is underway.
